Law has little autonomy: Law’s distinctively legal doctrines, principles, and procedures have little independent importance; legal “traditions” do not by themselves account for much of the current content of law.

법은 자율성이 거의 없다. 즉, 법이 가진 독특한 법적 원칙, 원리, 절차에 독자적인 중요성은 거의 없으며, 법의 ‘전통’이 그 자체로 현행법 내용의 많은 부분을 설명하지는 않는다. 

 

Law is constantly changing because society changes; when law seems to stand still, it does so not because of the force of precedent, inertia, or “lag,” but because powerful background forces have stalemated and current interests are pushing back against pressures for change.

법은 사회가 변화하기 때문에 끊임없이 변화하고 있는데, 법이 현상을 유지하는 것처럼 보일 때는 관례나 관성, 또는‘지연’의 힘 때문에 그런 것이 아니라, 강력한 이면의 영향력이 교착 상태가 되었고 현재 이익이 변화의 압박에 대항하고 있기 때문이다. 

 

Likewise, the forms of law —for example, whether it uses rules or standards, strict or loose interpretations of texts and legal instruments — are usually functions of background demands on legal systems.

이와 마찬가지로, 예컨대 법규를 사용하든 규범을 사용하든, 법문과 법률 문서에 대해 엄격한 해석을 사용하든 혹은 느슨한 해석을 사용하든, 법의 형태는 대개 이면의 요구가 법 체제에 작용한 것이다.

 

Change internal to the legal system cannot in itself bring about large social consequences.

법 체제의 내부 변화는 그 자체로 큰 사회적 결과를 가져올 수 없다. 

 

Law cannot consistently or for long periods remain out of sync with the interests of the powerful in society.

법은 끊임없이 혹은 오랫동안 사회 권력자들의 이익에 부합하지 않은 상태로 계속 있을 수 없다. 

 

The historian or social scientists looking for explanations of legal change will most likely find them in the study of social interests, forces, and demands — not in the doctrines, principles, or internal structures of the legal system.

법의 변화에 대한 설명을 찾고 있는 역사학자나 사회 과학자는 법 체제의 원칙이나 원리, 혹은 내부 구조에서가 아닌 사회적 이익, 영향력, 요구에 대한 연구에서 아마 그것들을 발견하게 될 것이다. 

 

Similarly, legal change is most likely to be effective when it is supported by powerful interests.

마찬가지로, 법의 변화는 강력한 이익에 의해 뒷받침될 때 효과적일 가능성이 가장 높다.
